Sixth Circuit Title II Oral Arguments Center on Major Questions Issue

The U.S. Court of Appeals for the Sixth Circuit heard oral arguments on the FCC’s “Open Internet” order. Parties opposing regulation of the internet through extensive Title II regulation raised Major Questions Doctrine issues, while the FCC argued that Congress has delegated authority to determine Title II status to the Commission. There is no indication of when the court will decide the case. The Sixth Circuit stayed the effects of the current Title II decision in the summer.

Broadband Reporting Still Needs Improvement, Rural Commenters Say

Two years after the FCC implemented the Broadband Data Collection (BDC) process, many broadband organizations continue to question whether the Commission has data accurate enough to determine service coverage and make judgments on where to provide federal funds for broadband construction. Rural organizations offered a long list of possible improvements in recent comments to the Commission.

Sixth Circuit Stays FCC’s Title II Order

The Sixth Circuit Appeals Court in Cincinnati has indefinitely stayed the effects of the FCC’s April order reinstating Title II telecommunications regulation of the internet. The Court found that ISPs challenging the order were likely to win the case ultimately on the merits and that the order could cause irreparable harm to the ISPs. FCC Chairwoman Jessica Rosenworcel vowed to continue fighting for net neutrality rules.
